Conditions of use
By using this website, you, the buyer certifies that you have read and reviewed this Agreement and that you agree to comply with its terms. If you do not want to be bound by the terms of this Agreement, you are advised to stop using the website accordingly. DTC Southwest Designs only grants use and access of this website, its products, and its services to those who have accepted its terms.
Privacy policy
Before continuing the use of our website, we advise the buyer to read our privacy policy Privacy Policy regarding our user data collection. It will help you better understand our practices.
Age restriction
Buyer must be at least 18 (eighteen) years of age before using this website. By using this website, the buyer warrants that you are at least 18 years of age and may legally adhere to this Agreement. DTC Southwest Designs assumes no responsibility for liabilities related to age misrepresentation.
Intellectual property
The buyer agrees that all materials, products, and services provided on this website are the property of DTC Southwest Designs, its affiliates, directors, officers, employees, agents, suppliers, or licensors including all copyrights, trade secrets, trademarks, patents, and other intellectual property. The buyer also agrees not to reproduce or redistribute the DTC Southwest Designs’ intellectual property in any way, including electronic, digital, or new trademark registrations.
The buyer grants DTC Southwest Designs a royalty-free and non-exclusive license to display, use, copy, transmit, and broadcast the content the buyer uploads and publishes. For issues regarding intellectual property claims, the buyer should contact the company in order to come to an agreement.
User accounts
As a user of this website, the buyer may be asked to register with DTC Southwest Designs and provide private information. The buyer is responsible for ensuring the accuracy of this information, and is responsible for maintaining the safety and security of personal identifying information. The buyer is also responsible for all activities that occur under your account or password.
If the buyer thinks there are any possible issues regarding the security of your account on the website, inform us immediately so we may address them accordingly.
We reserve all rights to terminate accounts, edit or remove content and cancel orders at our sole discretion.
Products and Services
DTC Southwest Designs does its best to ensure that descriptions of all products (jewelry) are accurate and the colors/sizes/shapes are adequately represented.
Additionally, we aim to ensure that a product for sale is in stock, however we cannot be held liable should a product be sold out, in which case we reserve the right to cancel your order.
We recognize that errors do happen and we give ourselves the right to correct wrong information, such as prices, and to cancel or refuse to process an order that was made based on misinformation.
Payment Information
Payments and refunds for products (jewelry) are managed through GoDaddy and methods include all major credit and debit cards, plus Apple Pay, Google Pay, and Paze wallet. PayPal is also accepted. GoDaddy Commerce Services Agreement is located at: www.godaddy.com/legal/agreements/commerce-services-agreement. Refunds are managed through GoDaddy.
Shipping
Processing time is the time needed to prepare an order for shipping, which is 1-3 days.
Shipping is free on domestic orders over $50. Shipping for orders under $50 is $10.
Customs and import taxes. Buyers are responsible for any customs and import taxes that may apply. DTC Southwest Designs is not responsible for delays due to customs.
Shipping Damage. If product arrives with the outer package clearly damaged, buyer is to take photos of package before opening. After opening, if product is also damaged, buyer should take pictures of the damaged item. Buyer will contact DTC Southwest Designs, return product, and forward pictures for insurance claim. DTC Southwest Designs will reimburse buyer for amount of purchase or replace item, if in stock.
Applicable law
By using this website, the buyer agrees that the laws of the state of New Mexico, without regard to principles of conflict laws, will govern these terms and conditions, or any dispute of any sort that might come between DTC Southwest Designs and you, or its business partners and associates.
Disputes
Any dispute related in any way to your use of this website or to products you purchase from us, if unresolved by informal means between buyer and DTC Southwest Designs, shall be arbitrated by state or federal court in Albuquerque, New Mexico, USA and you consent to exclusive jurisdiction and venue of such courts.
Indemnification
Buyer agrees to indemnify DTC Southwest Designs and its affiliates and hold DTC Southwest Designs harmless against legal claims and demands that may arise from buyer’s use or misuse of our services. DTC Southwest Designs reserves the right to select our own legal counsel.
Limitation on liability
DTC Southwest Designs is not liable for any damages that may occur to you as a result of your misuse of our website and/or products buyer has purchased through this website.
DTC Southwest Designs reserves the right to edit, modify, and change this Agreement at any time. We shall let our users know of these changes through electronic mail. This Agreement is an understanding between DTC Southwest Designs and the user, and this supersedes and replaces all prior agreements regarding the use of this website.
Returns/Refunds/Exchanges
We appreciate your purchase and if for some reason you are not completely satisfied, you may return it to us for a full refund, store credit, or an exchange. Please see below for more information on our return policy.
Returns. All returns must be postmarked no less than 14 days of the purchase date. All returned items must be in new, unused, and in undamaged condition.
Return Process. To return an item, please email us (dtcsouthwestdesigns@gmail.com) and identify the reason for the return. You may call us (505-554-4781) to start the process, however an email is important to document the process. The initial contact must occur within 7 days of the item purchase. Once the return request is approved, place the item securely in its original packaging and mail your return to the following address:

Please note. The buyer will be responsible for all return shipping charges. We strongly recommend that the buyer use a trackable method to mail a return.
Refunds. After receiving the returned item and inspecting the condition of your item, we will process your return or exchange. Please allow at least 3 days from the receipt of your item to process your return/exchange. The inspection will determine if a full, partial, or rejection for refund. If the item appears used or damaged, request for a refund may be rejected or only partially refunded depending on the condition of the jewelry piece. Pictures verifying the condition of the piece will be documented. Once approved, refunds may take 5-7 days to reappear in your account.
Exchange. At the initial request for an exchange via email/telephone contact, the buyer may request an exchange of an item based on various factors. For example, the buyer may need a smaller size (e.g., ring), or a different metal (copper versus silver). If a comparable item is in stock or can be created with the buyer’s request, DTC Southwest Designs will come to an agreement with the buyer for an exchange. The return of the exchanged item will follow above procedures under “Returns.” An agreement may be reached for an exchange which costs the same, more, or less than the original value. In all cases, all decisions will be reached between buyer and DTC Southwest Designs.
